guidelines for law enforcement

These guidelines are intended for law enforcement authorities seeking information relating to sportsclues brand Web Site accounts. In certain circumstances, you may seek to withhold content on sportsclues Web Site accounts, as provided below. For general information, please see our Terms of Service, Privacy Policy, CCPA Privacy Policy, Child Sexual Exploitation Policy, and GDPR Policy.

1. Withholding Content

Sportsclues Web Site seeks to honor freedom of expression on its platform while respecting applicable federal and local laws. Therefore, from time to time, content, including sportsclues content, or an account may be withheld or deleted.

There may be applicable laws in the United States or in local jurisdictions that may apply to sportsclues and/or content on a sportsclues Web Site account. If we receive a valid and properly specified request from an authorized entity or law enforcement authorities, it may be necessary to withhold access to certain content or a sportsclues Web Site account from time to time. Such withheld content will be limited to the specific jurisdiction that has issued the valid legal demand or where the content has been found to violate specific federal and/or local laws.

sportsclues maintains a notice policy for withheld content. Upon receipt of a request to withhold content, we will promptly notify affected users unless we are prohibited from doing so (e.g., if we receive a court order under seal). When content has been withheld, we also clearly indicate within the product and publish requests to withhold content—unless, similar to our practice of notifying users, we are prohibited from doing so.

At sportsclues, we will always strive for the open and free exchange of information.

2. Record Preservation

We will accept valid legal requests from law enforcement agencies to preserve records that constitute potentially relevant evidence in legal proceedings. We will preserve, but not disclose, a temporary screenshot of the relevant account records for a period of 90 days pending receipt of valid legal process served in accordance with applicable laws.

Preservation requests, in accordance with applicable law, should:

– be signed by the requesting official or law enforcement officer;

– have a valid return official email address and mailing address;

– have a valid return official phone number;

Provide details about what specific information is requested (e.g., basic subscriber information) and its relationship to your investigation and why it needs to be preserved;

– include the @username and URL of the subject sportsclues Web Site account profile; and

– be sent on law enforcement letterhead in a non-editable format(such as PDF).

Upon written request, we may honor requests for extensions of preservation requests. However, law enforcement agencies are urged to seek records through the appropriate channels in a timely manner and to submit record preservation requests as soon as practical as we cannot guarantee that requested information will be available.

If you will be submitting a preservation extension request, we recommend that you submit it no less than 7 calendar days prior to the end of the preservation period, to allow for sufficient processing time.

3. Types of Record Requests

Requests for records as to user account information from law enforcement should be directed to Broadcurrent S.P. We will only respond to valid legal process issued in accordance with applicable law.

A. Any private information requires a valid subpoena or court order

All non-public information about sportsclues Web Site accounts and users will not be released to law enforcement except in response to valid legal process, including but not limited to a subpoena, search warrant, court order or other valid legal process.

B. Contents of communications requires a search warrant

Requests for the contents of communications (e.g., sportsclues, Direct Messages or photos) shall require a valid search warrant, court order or equivalent from an agency with proper and valid jurisdiction over the subject matter and persons involved.

C. Notification as to records request

Upon receipt of a valid legal request for account information or content of a user, we shall notify the user(s) who is the subject of the request under our policies. We may also provide a copy of the request to the user(s) unless we are prohibited from doing so by applicable law, by court order or due to exigent circumstances such as regarding imminent threat to life or child sexual exploitation.

D. Records Production

Unless otherwise agreed upon, we provide responsive records in electronic format by email transmission. Upon request, the records that we produce will be electronically signed to ensure their integrity at the time of production. We may seek reimbursement for all costs associated with gathering and producing said records pursuant to legal papers and as provided by applicable law.

4. Emergency requests

Under our Privacy Policies, we may disclose user account information to law enforcement in response to a valid and legal emergency request.

Emergency requests from law enforcement are handled only on a case-by-case basis in compliance with applicable law. If we receive information that provides us with a good faith belief that there is an exigent emergency involving a danger of death or serious physical injury to a person, we may provide any available information necessary to prevent that harm.

If there is an exigent emergency that involves the danger of death or serious physical injury to a person that we may have information necessary to prevent, law enforcement officers can submit an emergency request to legal@broadcurrent.com. Be sure to include the Identity of the person who is in danger of death or serious physical injury and nature of the emergency circumstances.
